It is now a legal requirement that all landlords must carry out an immigration check under the new legislation ‘Right to rent’.
Landlord’s are required to keep up to date with their tenant’s immigration status. Failure to do so could mean they will be faced with a £3000.00 penalty.
For some landlord’s this may impact on their selection of tenant’s, however you will need to be mindful of the potential consequences of discriminating against a tenant simply because of their nationality. The tenant could potentially sue the landlord under the 2010 Equality Act, “An award for “injury to feelings”, for example, would be in the region of £6,600.”
This new piece of legislation could prove to be a testing one with its added administration requirements and potential ramifications should a landlord not identify an illegal tenant.
